Purposes of processing personal data for applications and, in the application process, the legal basis


If you apply to us electronically, i.e., by e-mail or via our web form, we will collect and process your personal data for the purpose of processing the application procedure and carrying out pre-contractual measures. In particular, this involves processing your master and contact data, your application documents, and data on your professional experience, knowledge, and qualifications that you provide to us as part of the application process.

By submitting an application on our recruiting page, you express your interest in taking up employment with us. In this context, you provide us with personal data that we use and store exclusively for the purpose of your job search/application. You are not required to provide any special categories of personal data, such as health data. If you nevertheless do so, you agree at the same time that we may process this data. Once you have given your consent, you can revoke it at any time, with effect for the future. 

The data processing is carried out on the basis of Article 88 of the Basic Data Protection Regulation (DSGVO) in conjunction with Section 26 (1) of the BDSG, Article 9 (2) a) or b) DSGVO.


Recipients

Only authorized employees from the HR department or employees involved in the application process have access to your data.

The data transmitted in the context of your application will be transferred via TLS encryption and stored in a database. This database is operated by Personio GmbH, which offers personnel administration and applicant management software (https://www.personio.com/legal-notice/). Personio is our processor in this context, according to Article 28 DSGVO. We have concluded a contract with Personio, according to which Personio undertakes to process the data only on our instructions and to protect it from access by third parties. A third-country transfer of your data does not take place.


Storage period

Personal data is stored exclusively for the purpose of filling the vacant position for which you have applied. If your application is successful, we will store it for the duration of the employment relationship with you, about which we will inform you accordingly. Otherwise, your data will be stored for a period of up to 6 months beyond the end of the application process. This is usually done to fulfill legal obligations or to assert, defend and defend any claims (based on legitimate interests according to Article 6(1) f) DSGVO). Subsequently, we are obliged to delete or anonymize your data. In this case, the data will only be available to us as so-called metadata without direct reference to persons for statistical evaluations (for example, the proportion of women or men in applications, number of applications per period, etc.).

If you give your explicit consent, we will store your data for inclusion in our "Talent Pool" even after the application process has ended in order to identify any other interesting positions for you.


Your rights

Under the General Data Protection Regulation (GDPR) and applicable national law, you have a number of rights in relation to your personal data:  

You can also revoke consent once given at any time. However, this revocation is only valid for the future. Any processing that took place before the revocation remains unaffected.  

Your right to information and copy in accordance with Article 15 DSGVO, in particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data, if it was not collected by us, as well as the existence of automated decision-making, including profiling and, if applicable, meaningful information about its details.  

Your right to rectification is in accordance with Article 16 DSGVO; for example, if your data is incomplete or inaccurate, you can request us to correct it.  

Your right to erasure is pursuant to Article 17 DSGVO if it is not (any longer) necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defense of legal claims.  

Your right to restriction of processing pursuant to Article 18 DSGVO. You may request that your data be blocked, for example, because you believe the data is inaccurate or the processing is unlawful, but you object to its erasure because you need it to assert, exercise or defend legal claims or you have objected to the processing pursuant to Article 21 DSGVO.  

Your right to data portability is pursuant to Article 20 DSGVO. You may request that we hand over the data you have provided to us in a structured, common, and machine-readable format or transfer it to another controller.  

Finally, you also have the right to lodge a complaint with the competent data protection supervisory authority (Article 77 GDPR). You can file this complaint both at your place of residence, at your place of work, or at the place of the data protection breach you are complaining about. You can also file a complaint with the supervisory authority at our registered offices.

Information about your right to object under Article 21 DSGVO: You have the right to object at any time, on grounds relating to your particular situation, to the processing of your data carried out on the basis of Article 6(1)(e) DSGVO (data processing in the public interest) and Article 6(1)(f) DSGVO (data processing on the basis of a balance of interests). If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for processing that override your interests, rights, and freedoms. The objection can be made without any formalities.

Compay GmbH reserves the right to adapt this data protection declaration at any time so that it always complies with the current legal requirements or in order to implement changes to the services in the data protection declaration, for example, when introducing new services. Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.
